All About The Class 3 License

The Class 3 License appertains to a small arms dealer who’s paid a tax named the “Special Occupational Tax” to conduct business with machine guns and various other military weapons or “National Firearms Act weapons” or NFA for short.  This is the type of FFL License that most enthusiasts go after. I can’t blame them either, the class 3 FFL license allows it’s holders to do all of the fun stuff, mainly buying and selling fully auto weapons.

Machine guns, Noise suppressors, Snub Barrel Rifles, Shotguns, or Any Other Weapons  are checked and assessed under the  control of the national Firearms Act circa 1934 ( NFA ) as altered by Title II of the Gun Control Act ( GCA ) in 1968.

If you want to deal in NFA firearms, silencers or explosives you will need to get yourself a class 3 license.

Class Three License- The Many Types Of FFL’s

Semi-automatic and other firearms excluding big-bore or destructive explosive devices are controlled by Title one in the Gun Control Act ( GCA ). What many people accidentally call Class Three License is correctly known as NFA or Title two firearms. Figuring out what type off ffl you need can be a task in itself. There are many different types of ffl licenses as you can see below.

• A Class 3 License SOT dealer refers to a dealer of NFA fire-arms
• A Class two SOT manufacturer refers to a manufacturer of NFA fire-arms
• A Class one SOT importer refers to an importer of NFA fire-arms
• Type one FFL pertains to a Title one gunsmith or dealer
• Type two FFL pertains to a Title one dealer conducting business as a pawnbroker
• Type three FFL pertains to an approved collector of Curio & Relic ( CR ) firearms
• Type six FFL pertains to an approved maker of ammo and reloading parts apart from Armor Piercing ammo
• Type seven FFL pertains to a Title one manufacturer of firearms, ammo and ammo elements apart from NFA, Destructive Devices and Armor Piercing ammo Type eight FFL pertains to an importer of Title one firearms and ammo
• Type nine FFL pertains to an FFL dealer in Title one fire-arms to include NFA destructive devices, but not to include other NFA
• Type ten FFL pertains to a maker of Title one firearms, ammo and ammo elements, to include NFA Destructive Devices and no other NFA, and excluding Armor Piercing ammo
• Type eleven FFL pertains to an importer of Title one firearms, ammo and NFA Destructive Devices, but no other NFA

To obtain a Class Three License SOT standing, you will want a dealer or manufacturer FFL that includes Type one, two, seven, eight, nine, ten or eleven.

Do You Need An FFL Kit To Get A Class 3 License?

While you don’t “need” an FFL Kit to get your class three FFL license it’s definitely a good idea. I often visit gun forums and hear that you don’t need a kit for the class 3. I would agree with them if this were 7 years ago, times have changed.

Years ago it was easier to get your class 3 license but these days the ATF makes it tricky to keep the numbers of class 3 holders as low as possible.  Once you get denied you get blacklisted and won’t get approved ever you also do not get your application fee back.
